Terms of Use

ARTICLE 1. GENERAL INFORMATION
1.1 Terms and Conditions of Use include all of the content, products or services or other services we provide, listed on www.medibo.net and our mobile application. We recommend that you read these terms and conditions carefully before ordering a product from our website or third-party app stores (e.g. Apple App Store, Android Play Store). The terms “Medibo”, “we” or “us” refer to medibo.net. The term “device” refers to any device used to access products, including but not limited to computers, smartphones and tablets. The terms “You”, “Subscriber”, “User” refer to the user of the products. When ordering or otherwise using or accessing any product, you agree to comply with these terms and all applicable laws, rules and regulations. By using the products, you indicate that you accept these terms and agree to abide by them. If you do not accept these terms, please refrain from using the products.
1.2 Medibo reserves the right to change or update the Terms of Use at any time. These additions, changes, edits, or cancellations are posted on the website as soon as they are announced. It becomes valid when published on the website. By continuing to use the products, users are deemed to have accepted the changes and all updates made to the terms.
ARTICLE 2. MEMBERSHIP AND SUBSCRIPTION
2.1 By logging into the application and the site, you become a member of Medibo products. Becoming a member is free. Your membership information is private to you and the owner of the membership is responsible for its confidentiality.
2.2 During your use of the Products, you may be asked to provide us with certain personal information (hereinafter referred to as "User Information"). This information may also include information about facebook and similar social network profiles. You acknowledge and agree that you are solely responsible for the accuracy and content of user information.
2.3 As a member; You declare that you have the capacity to conclude a contract, that the information you provide is correct, that your use of our products is not against any law/regulation, and that you are over 18 years old. Persons under the age of 18 may only use our products with the consent of a parent or legal guardian.
2.4 Medibo has two different subscriptions, paid and free. With a free subscription, only limited access to the application is possible, but the scope and duration of the free content is entirely up to the content provider (Medibo). Medibo reserves the right to make changes to the free subscription access. It implements a paid subscription system that allows access to all content within the application for a fee determined by Medibo. All content is accessible while the subscription is active and ongoing. With subscription inactivity, access to content is partially or completely restricted. You can subscribe to the subscription program by purchasing products from the website, within the applications, from the places allowed by the application market partners. Purchases from the Apple iTunes Store, Apple App Store app stores are subject to Apple's non-refundable payment policy. If you made your purchase from the Google Play app store, the sale is final and non-refundable. Your purchase is subject to Google Play's non-refundable payment policy.
2.5 Medibo offers paid monthly and annual subscription packages. The duration is calculated as 30 days for monthly subscriptions and 365 days for annual subscriptions. Medibo reserves the right to change the prices of subscription packages.
2.6 Monthly subscription is charged every month, annual subscription is automatically charged annually. You acknowledge and agree that the subscription fee will continue to be billed automatically while your subscription is active (with plans determined according to the package purchased by the subscriber). The subscriber can unconditionally terminate his membership at any time. Subscription termination can only be done by the user on the platform (App Store, Google Play) from which he made the purchase.
2.7 The subscriber is responsible for any applicable fees and charges, including any subscriptions purchased by you.
2.8 In order to use all the features of the application without interruption, the user's device must meet certain conditions. Medibo cannot be held responsible for any disruptions, interruptions and violations that may occur because the user's device does not meet the necessary conditions.
2.9 Medibo reserves the right to change the scope, price and content of the subscription plans.
ARTICLE 3. SUBSCRIPTION CANCELLATION
3.1 The user can cancel the subscription plan he/she uses at any time. Cancellation takes effect at the end of the current plan. The user may continue to use their valid rights until the end of the period.
3.2 If you have purchased your subscription through the Google Play Store, you can only cancel your subscription yourself through Google Play. If you bought your subscription from Apple, App Store, you can only cancel your subscription yourself through the App Store.
3.3 We may suspend or terminate your use of the products if you breach any obligation under the terms of use. Such termination or suspension may occur immediately and without notice.
ARTICLE 4. RETURN POLICY
4.1 Products purchased from medibo.net can be refunded only if the user requests a refund within the refund period specified below in this policy. Some products are not refundable under all conditions or may have different policies or requirements for refunds associated with these products. Please see below for the return terms applicable to such products.
4.2 Return requests can only be made to the e-mail address “destek@medibo.net”. Any other request made through other channels will not be valid. Return requests must include the 16-digit order number.
4.3 “Transaction Date” means the purchase date of any product or service, including any renewal date processed by Medibo.
4.3 No refund can be made in case the account of the said request is closed before requesting a refund or before the refund process is fully realized. 4.4 Monthly Subscription Plan Refund: Refund requests made within 48 hours from the transaction date will be refunded. Refund requests made after 48 hours have passed from the transaction date will be deemed invalid. Monthly plans cover all subscription plans less than 1 year. (For example 1 month, 3 months, 11 months etc.)
4.5-Year Subscription Plan Refund: For refund requests made within 48 hours from the transaction date, the full subscription fee is refunded. After 48 hours, refund requests made within 14 days (including the 14th day) will be refunded by deducting the MONTHLY SUBSCRIPTION PLAN fee. MONTHLY SUBSCRIPTION PLAN fee is based on the current MONTHLY SUBSCRIPTION PLAN fee on the transaction date. Refund requests made after 14 days from the transaction date are invalid.
4.5 This return policy only covers purchases made through the Google Play Store (Android). ARTICLE 5. PROHIBITED USES
5.1 You agree not to interfere with, damage, destroy or limit the functionality of any computer software, virus or hardware and products. 5.2 You agree not to download, copy, send any material with software viruses, computer code, files or sharing programs. You agree not to use the products for purposes related to scientific research, analysis and evaluation.
5.3 You agree not to impersonate another person when using the Products, and not to impersonate anyone else's official information, photographs or any other distinctive information.
5.4 Your violation of any of this clause (all of clause 4) may constitute a criminal offence. In case of violation, Medibo reserves the right to use its legal rights.
ARTICLE 6. PRODUCT WARRANTY AND ACCESS
6.1 Medibo always tries to provide the best service to its users. However, this may not always be possible and some errors, technical problems or loss of access may occur. Medibo does not guarantee that these and similar situations will not occur. If you encounter a problem, you can report the problem via the e-mail address: support@medibo.net.
ARTICLE 7. MEDICAL DISCLAIMER
7.1 Medibo is in no way a healthcare or medical treatment provider or healthcare provider. Medibo only provides meditation content for a more positive life. Although it is stated in many 3rd party studies that meditation has many benefits, Medibo does not make any therapeutic claims or guarantees.
7.2 Advice and recommendations given on the products are for general information purposes only. It does not have any therapeutic purpose. 7.3 If you are experiencing serious health problems such as depression and anxiety, we recommend that you use the products, services and contents in the Medibo application under the control of a healthcare professional.
7.4 Meditation practices should never be used as a substitute for medical treatment practices. 7.5 You agree that the Medibo meditation application cannot be held responsible for any consequences that may arise from your use and use of the products, services and contents within the Medibo application of your own free will.
ARTICLE 8. RIGHTS OF USE
8.1 Subject to the terms of this agreement, upon paying the applicable subscription fee, the user grants the subscriber a revocable right to use non-personal content. This right does not extend to commercial use.
8.2 You agree that you will not do or allow the following to be done, that all rights will be revoked if you do, and you will be held legally responsible if you do. These behaviors are;
– Copying, storing, duplicating, modifying, applying reverse engineering methods, imitating, disassembling, making derivatives of the content or some or all of the content,
– Renting, lending, making public, selling. ARTICLE 9. SCOPE
9.1 These terms and any clauses expressly stated therein constitute the entire agreement between Medibo and the user and supersede any previous discussion, correspondence, arrangement or agreement on the subject.
9.2 If any provision of these terms is found to be unenforceable, this term will be removed and the remaining provisions will remain valid and enforceable.
ARTICLE 10. DISPUTES
10.1 The provisions of the Code of Obligations will be used in matters not mentioned in this contract. In case of any dispute, Istanbul (Anatolian) Courts are authorized in the dispute. If it cannot be resolved here, all Istanbul Courts will be authorized.
